OPINION
ACKERMAN, District Judge.
This matter comes before the court pursuant to 28 U.S.C. § 636(e)(4) on plaintiffs appeal of Magistrate Judge Stanley R. Chesler’s decision to grant defendant’s motion for summary judgment. For the reasons detailed below, this court affirms the Magistrate’s grant of defendant’s summary judgment motion.
