I. INTRODUCTION

This matter is before the Court on Defendants’ Motion to Dismiss Plaintiffs Complaint. Plaintiff Dr. Jay S. Gunasekera (“Dr.Gunasekera”), brought a complaint against Defendants Dean Dennis Irwin and Provost Kathy Krendl (collectively “Defendants” or individually “Dean Irwin” or “Provost Krendl”) for damages under 42 U.S.C. § 1983 and for injunctive relief.
