Order unanimously modified, on the law, and, as modified, affirmed, without costs, in accordance with the following memorandum: Plaintiff was injured when a truck he was repairing fell on him due to an alleged defect in a forklift supporting the truck. Defendant Pettibone Mercury Corp. (Pettibone) manufactured and designed the forklift. Plaintiff alleged against Pettibone causes of action in strict product liability, negligence for improper and inadequate design and failure to warn, and breach of express and implied warranties.
