Per Curiam: This case comes before the court on plaintiff’s motion, filed October 25, 1978, pursuant to Eule 141 (b) that the court adopt, as the basis for its judgment in this case, the recommended decision of Trial Judge Philip E. Miller, filed September 6, 1973, pursuant to Eule 131(c), defendant having filed no opposition or notice of intention to except thereto. Upon consideration thereof and without oral argument, since the court agrees with the decision, as hereinafter set forth, it hereby grants plaintiff’s motion and affirms and adopts the decision as the basis for its judgment in…
