Gordon DeSimone and James DeSimone, brothers, together with Ered and Don Schaible, also brothers, were indicted in the criminal court of Cook County for the murder of John Hodaly during the course of an attempted robbery. After pleading not guilty they were jointly tried by a jury which returned verdicts finding the Schaible brothers not guilty and the DeSimone brothers guilty. The punishment of Gordon DeSimone was fixed at death while that of James DeSimone was fixed at 40 years imprisonment in the penitentiary.
