MINTON, Circuit Judge.

The State has appealed from a judgment of the District Court which released the relator from the custody of the Warden of the Illinois State Penitentiary, who held him Under a life sentence, pursuant to a conviction in the Criminal Court of Cook County, Illinois. The District Court granted a certificate of probable cause. It is admitted that the relator has exhausted his State remedies.
