Albert Klinklef instituted liis action of trespass on the case, in the Circuit Court of Ohio county ^September 19, .1893, against the Wheeling' Steel & Iron Company, alleging injuries to the person of the plaintil! as the result of carelessness and negligence on the part of defendant company.
