This is an action of ejectment brought by the plaintiff against the defendant for the recovery of “ about two and seven-eighths acres of land, that is to'say, all that certain house and lot of land situate in the town of Harrisville,” and described in the declaration by metes and bounds. The action was brought in the circuit court of Ritchie county, and the defendant was served with a copy of the declaration on the 18th day of July 1873.
