SCHATZ, District Judge.

I. INTRODUCTION

This is a civil action brought by Ray Marshall, as Secretary of Labor of the United States Department of Labor, under the Fair Labor Standards Act of 1938, as amended, 29 U.S.C.A. § 201 et seq. (hereinafter FLSA or the Act). The Secretary brings this action to enjoin defendants from violating the provisions of §§ 15(a)(2) and 15(a)(5) of the Act, 29 U.S.C.A. §§ 215(a)(2) and 215(a)(5), pursuant to § 17 of the Act, 29 U.S.C.A. § 217; and to recover unpaid minimum wages and overtime compensation allegedly owing to defendants’ employees, together with an…
