Damien Hernandez Cortez was convicted of fraudulently possessing five or more but less than ten items of identifying information. In seeking to overturn that conviction, he contends 1) the trial court erred in failing to include a jury instruction on a presumed fact, 2) the trial court erred in failing to include a jury instruction on vol-untariness, 3) the trial court erred in using the phrase “identifying information” in place of the phrase “item of identifying information” in the application paragraph of the jury charge, 4) the trial court erred in failing…
