This case arises from the denial of insurance coverage by the defendant, Acadia Insurance Company (“Acadia"), to the plaintiff, Gray Excavation, Inc. (“Gray”), for damage that occurred to Gray’s equipment on its job site. Gray filed this action against Acadia, for breach of contract, negligence, and violation of General Laws Chapter 93A and Chapter 176D. Specifically, Gray alleges that Acadia improperly handled Gray’s claim under the policy and conducted its investigation of Gray’s claim in bad faith.
