OPINION AND ORDER REGARDING CONSERVATION RESERVE PROGRAM PAYMENTS IN EASTERN COLORADO BANK’S MOTION FOR RELIEF FROM STAY

This matter arises from the motion for relief from stay of Eastern Colorado Bank (the Bank). The Bank contends that it is entitled to relief from stay to collect the proceeds of payments made to the debtors in the form of Commodity Credit Corporation commodity certificates as “rents” under an assignment of rents provision in a deed of trust held by the Bank as security for a promissory note from the debtors.
