The salient facts in this case are not in dispute. The action was brought to recover damages for injuries which the plaintiff sustained in consequence of the alleged negligence of the defendant in running a mowing machine against the plaintiff, and cutting off his left foot and injuring his right leg on July 7, 1916, the plaintiff, at that time, being five years of age.
