Joseph Mackey instituted an action against the City Council of Augusta, to recover damages for personal injuries which he received by the falling of a horse which he was riding across a public highway in Richmond county, outside of the corporate limits of the city, and for which he alleged the city was hable to him, because of certain facts set out. in his petition, a summary of which is as follows: By an act of the General Assembly the City of Augusta was authorized to increase its water supply, by constructing waterworks beyond the corporate limits of the city, and to purchase and hold…
