This is an appeal from a judgment wherein the appellant was convicted of violating the provisions of section 288 of the Penal Code.

In an information filed in Los Angeles County, it was charged that the defendant did, on or about July 17, 1956, commit a lewd act upon the body of Sandra L. Steiner, a child of the age of 9 years, with the intent of arousing, appealing to and gratifying the lusts, passions and sexual desires of the child and of the defendant.
