Defendants appeal as of right from an order of the Oakland Circuit Court granting plaintiffs motion for partial summary disposition as to Count ii of plaintiffs complaint.

This appeal has a long and protracted history including appeals to this Court and the Supreme Court. Defendants, Douglas and Sylvia Wheeling, once owned residential property at 3570 Bald Mountain Road, Pontiac, Michigan.
