KELLEY, District Judge.
Plaintiff Resource Bank (“Resource” or the “Bank”) is a defendant in two class action lawsuits that seek millions of dollars in damages for violations of the Telephone Consumer Protection Act (“TCPA”), 47 U.S.C. § 227. Resource initially failed to obtain indemnity and a defense of the lawsuits from St. Paul Mercury Insurance Company (“St.Paul”), the carrier that underwrote its general liability policy (the “GL Policy”).
