The Central Trust Company, after answering the bill of McBee & Co., challenged the jurisdiction of the circuit court to entertain *762it, by a motion to dismiss, and the denial of its motion is one of its assignments of error. The jurisdiction was sustained by Judge Key in the court below on the ground that the bill was ancillary to the bill of the Central Trust Company against the Marietta & North Georgia Railway Company.
