Lou Haddock, Peter Wiberg, Alan Gouse, Edward Kaplan, and Dennis Fer-don are trustees of employer-sponsored, profit-sharing retirement plans (collectively “Trustees”). The Trustees have sued Nationwide Financial Services Inc. and Nationwide Life Insurance Co. (collectively “Nationwide”) under the Employee Retirement Income Security Act (“ERISA”), 29 U.S.C. § 1101 et seq., seeking monetary damages and equitable relief.
