Given, Judge:

Ada P. Nester instituted her action of trespass on the case against United Foundation Corporation and the Town of Ridgeley, a municipal corporation, in the Circuit Court of Mineral County, claiming damages for personal injuries alleged to have resulted from negligence of defendants in failing to provide or maintain a temporary way or detour around an obstruction in Ridgeley Street. No appearance was made by the town in the lower court or in this Court.
