It is not claimed by the counsel of the plaintiff in error, that the declaration in the cause is defective. I have failed to find any substantial defect in the declaration and therefore do not see, that there was any error in overruling the demurrer. Though I am free to say, that I have not examined the declaration with that care I should, if it were claimed here by the distinguished counsel for the plaintiff in error, that the declaration was insufficient.
