In this action to recover damages for the alleged breach of an oral partnership agreement, *76the named plaintiff, Frank Usowski,1 appeals, and the defendants2 cross appeal, following our grant of certification, from the judgment of the Appellate Court. The plaintiff claims on his appeal that the Appellate Court improperly affirmed the judgment of the trial court dismissing the complaint.
