MEMORANDUM

HIGGINS, District Judge.

The Secretary of Labor, United States Department of Labor, brought this action on August 11, 1983, against National Health Corporation (NHC). The action was initiated by the former Secretary of Labor, Raymond J. Donovan, and is now maintained by the present Secretary of Labor, William E. Brock. The Secretary of Labor alleges that the defendant repeatedly and willfully violated provisions of the Fair Labor Standards Act (FLSA or Act), as amended, 29 U.S.C. 201, et seq. (1982), by employing persons for workweeks longer than forty (40) hours without compensating…
