The parties will be referred to as plaintiff and defendant as they appeared in the trial court. This is an action by J. Arch Butts, as plaintiff, against T. A. Simpson, in re-plevin and to foreclose a chattel mortgage. The facts, as shown by the record are substantially as follows: The defendant, T. A.
