I. INTRODUCTION
On November 20, 2009, plaintiff The Lincoln National Life Insurance Company (“plaintiff’) filed the present action against defendants Bayard J. Snyder (the “Trustee”), trustee of the Harry Wisner Irrevocable Life Insurance Trust (the “Trust”); Landon Strauss (“Strauss”); and Robert Fink (“Fink”) (collectively, “defendants”). (D.I. 1) Plaintiff alleges in its complaint that defendants fraudulently procured an $18.5 million insurance policy (the “Wisner Policy”) on the life of Harry Wisner (‘Wisner”).
