MEMORANDUM OPINION AND ORDER

HANNAH, District Judge.

Pending before the Court is Plaintiffs Motion for Summary Judgment. Upon due consideration of said Motion and the Responses thereto, the Court is of the opinion that Plaintiffs Motion for Summary Judgment be DENIED.

BACKGROUND

Plaintiff, Western Heritage Insurance Company, issued a liability insurance policy to George Sandstrom insuring his business known as The Waterhole. The deceased, Michael Kent Dean, was involved in a physical altercation at The Waterhole and subsequently died. Thereafter, the deceased’s Estate and heirs brought suit…
