I. Background

On October 12,1993, Plaintiff Michael Burton was injured while a passenger in the back seat of a car driven by Bonnie Truscott. Truscott, a Mountain West insured, was killed. Burton incurred $56,211.97 in medical expenses as a result of his injuries.

At the time of the wreck, Truscott held one insurance policy with Mountain West. The policy covered four vehicles. Truscott paid separate premiums for each vehicle. Each premium included $5,000 in medical payments (“med-pay”) coverage for insureds. Under the policy’s definition, an “insured” included…
