Many of the questions in the present record were decided by us at the last term of the Court in an appeal by this appellant against Davis’ administrators. That was an action of tresspass quare clausum fregit, for injuries alleged to have been done to the land of the intestate in his lifetime by the appellant.' This is an action of ejectment by the *602heirs of the<,same decedent. Defendant pleaded not guilty, and took defence on warrant.
