OPINION

MESSITTE, District Judge.

This proposed class action suit was removed from the Circuit Court for Calvert County. Anthony and Toni Williams, the two named Plaintiffs, on behalf of themselves and others similarly situated, have sued the Potomac Electric Power Company (PEPCO) for damages resulting from an oil discharge from a PEPCO pipeline that occurred on April 7, 2000 at or near Swanson Creek, a tributary of the Patux-ent River in Southern Maryland.
