[1] Upon a careful examination of the record, we find in the evidence sufficient to support the verdict of the jury, for, this being a writ of error, the *614rule is that, if there be any substantial evidence tending to support the verdict, it is enough, the proper weight to be given to the evidence not being 'within our province, which is confined to a consideration of exceptions to admission or rejection of evidence, and to the charge of the court and its refusal to charge.
