GERBER, Judge.

In December of 1985, appellee Shailesh Patel (defendant) entered an Alford plea 1 to a charge of aggravated assault. In exchange, the state agreed to drop a charge of resisting arrest and its allegation of dangerousness. Pursuant to the plea agreement (agreement), the trial court suspended the imposition of sentence and placed defendant on probation for 5 years.
