Plaintiffs in error, hereinafter referred to as defendants or by name, were charged in the information with unlawful possession of cannabis sativa L., commonly known as marijuana, and conspiracy to possess the same. The jury rendered a verdict of guilty against both defendants on each count. At the close of the People’s case, defendants moved for a judgment of acquittal on the grounds of insufficiency of the evidence to establish possession of the substance and error on the part of the trial court in failing to suppress certain evidence.
