INTRODUCTION
The Catholic Diocese of Wilmington, Inc. (the “Debtor”) is the debtor in this Chapter 11 case. Among its many activities, it operates a pooled investment pro gram on behalf of the Diocese. 2 The purpose of the pooled investment program is to combine the assets of the participants to provide them with investment opportunities that would be unavailable to them individually.
The Debtor operates the program through an account (the “PIA”) in the Debtor’s name. The first issue in this case is whether the funds in the PIA are property of the estate or…
