The issue is whether the delay between the date of the alleged offense and the date of the institution of criminal proceedings against James T. Rogers, defendant in error (hereinafter defendant), violated defendant’s right to due process of law under the fifth amendment to the United States Constitution and art. I, sec. 8 of the Wisconsin Constitution.
