HENDERSON, Judge.
Appellant was convicted of perjury and his punishment assessed at two years in the penitentiary; and prosecutes this appeal.
The indictment in this case is predicated on an alleged perjury by appellant on the trial of a local option case; the assignment being substantially that on the trial of said case, John Kelley (this appellant), swore that he did not on the certain occasion inquired about sell intoxicating liquor to Sam Bishop, which was alleged to be material, and the falsity thereof was charged.
