MURPHY, District Judge.

Defendants found guilty by verdict of a jury of conspiracy to defraud the United States, 18 U.S.C.A. § 371, move in arrest of judgment, 1 for judgment of acquittal, 2 and for a new trial. To place the problem in its proper setting it will be recalled that the Serviceman’s Readjustment Act of 1944 3 authorized a program of education and training for. veterans under the. supervision of the Administrator of Veterans Affairs and empowered the Administrator to prescribe and promulgate such rules and. regulations as may be necessary to carry out its purposes and provisions 4
