SUTTLE, District Judge:

Appellant and George Lamar Naz-worth were each convicted on three counts concerning the operation of an illegal distillery.1 The facts, viewed *1086most favorably to the government, are typically simple. Special Investigator Gazzola, of the Alcohol and Tobacco Tax Division, along with various Florida Beverage Enforcement Agents, began surveillance of a recently discovered illegal distillery in the early morning hours of August 23, 1966.
