On the 25th day of October, 1912, the plaintiff began this action to recover possession of 24 hogs and a lot of other personal property described in the original complaint. On November 21, 1912, the defendant filed an answer to said complaint. On October 20, 1912, the plaintiff filed a motion for leave to file an amended complaint, and appended to his motion a copy of the proposed amended pleading. It appears that said amended complaint adds to the property sought to be recovered by the original complaint 17 *467tons of baled timothy hay of the alleged value of $175.
