This civil action is before the Court on the following motions; (1) defendant Frank J. Russo’s motion to dismiss pursuant to Fed.R.Civ.P. 12(b)(6) or in the alternative for summary judgment pursuant to Fed.R. Civ.P. 56; and (2) defendants Gail Roberts and RTC Management’s motion to dismiss pursuant to the doctrine of federal abstention because a prior state action is pending.
