HEMPHILL, District Judge.

Heard at Greenville, S. C., this action precipitated issues of liability and damages within the jurisdiction of this court over matters involving civil rights.1 Demand for jury trial was not made under Rule 38, Rules of Civil Procedure; pleadings and testimony were presented before the court, in open session, under Rule 52 (a), Rules of Civil Procedure, United States District Courts.
