Plaintiff Winthrop Resources Corporation (“Winthrop”) brings a claim for breach of a lease agreement against defendants Sabert Corporation and Sabert Holding Corporation (collectively “Sabert”). Sabert brings counterclaims for unjust enrichment and breach of contract. This matter is before the Court on Winthrop’s motion for summary judgment on both its claim against Sabert and Sabert’s counterclaims against it.
