This is a proceeding to reverse an order of the court below denying plaintiff’s application to dismiss his action without prejudice, and sustaining a demurrer to plaintiff’s evidence. The action was brought to recover damages for personal injuries alleged to have been sustained by the plaintiff through the negligence of defendant’s agents and employees.
