Judgment of the Supreme Court, New York County (Donald Mark, J.), rendered November 28, 1988, convicting defendant, after a jury trial, of criminal sale of a controlled substance in the third degree (Penal Law § 220.39) and sentencing him as a predicate felon to an indeterminate term of imprisonment of from 5 to 10 years, unanimously affirmed.

Defendant contends that he was deprived of due process by the court’s charge on reasonable doubt and by its omission of a "police witness” charge. These contentions are not preserved as a matter of law and we decline to reach them (CPL 470.05 [2]). Were…
