In August, 1935, the county board of commissioners of Clarendon County, for the purpose of widening a public road, instituted proceedings for the condemnation of a small part of a tract of land which had been conveyed to the trustees of Zero Church for a burial ground and place of worship. From the decision of the commissioners an appeal was taken to the Circuit Court, which found against the contentions of the owner of the land that the county board was without authority or power to condemn the property for road purposes.
