This case arises out of a traffic accident occurring on highway US-12, near Oshtemo, Michigan, about 7 o’clock in the evening of March 4,1945. A tractor, with semitrailer attached, owned by plaintiff Newkirk and operated by his employee, David Holley, was proceeding in a westerly direction on said highway. Plaintiff’s driver undertook to pass a station wagon, traveling in the same direction, belonging to defendant and operated by defendant’s driver, James Wilson.
