This is an action for damages resulting from injuries sustained by Alex Lynn Cole, a five-year-old boy.
The essential facts necessary to a determination of the issues involved are as follows: On July 19, 1945, at about 2:30 p.m., defendant Eugene Austin was operating a delivery wagon, driving south on River road and was making a right-hand or westerly turn into Lake street, south of the village of Com-stock.
