HODGES, Associate Justice.

The judgment from which this appeal is prosecuted is based upon an action for damages resulting from personal injuries received by the appellee through the alleged negligence of appellant’s agents in operating a train. The evidence shows that, about the 8th of December, 1905, the appellee was struck by one of the appellant’s box cars then being pushed along its main line track at Colgate, Oklahoma.
