MEMORANDUM & ORDER

BLOCK, District Judge:

Plaintiff Arkady Frank (“Frank”) brings this action pursuant to 42 U.S.C. §§ 405(g) and 1383(c)(3) of the Social Security Act (“Act”), seeking review of the denial of his application for Supplemental Security Income benefits (“SSI”) under Title XVI of the Act by the Secretary of the Department of Health and Human Services (“HHS”). Both parties have filed motions for judgment on the pleadings pursuant to Federal Rule of Civil Procedure 12(c).
