The plaintiff is suing the defendant for $390.34. The defendant admits the sum of $250, but denies liability as to the balance. The facts are as follows: The plaintiff in this action was the defendant in the action of Donegan v. Olesen, which had been pending in the Supreme Court, New York county. In the action of Donegan v. Olesen, certain property of Olesen was attached, and Donegan filed an undertaking which was approved.
