The bill of exceptions is to review a judgment of' the trial court, which refused to abate the plaintiff’s action. This, is a second suit by the plaintiff, L. H. Newman, against the de-. fendant, the Louisville and Nashville Bailroad Company, for the. same cause of action. In the first suit the Atlanta, Knoxville and. Northern Bailway Company, a Georgia corporation, was jointly-sued with the Louisville and Nashville Bailroad Company; and the-latter company filed its petition at the appearance term of the, court for the removal of the ease to the circuit court of the United.
